1. ACCEPTED FORMS OF PAYMENT: Morningstar, LLC will accept payments in the form of Cash, Certified Check, Cashier's Check, Visa, or MasterCard.
2. DEPOSIT: A 25% non-refundable deposit (25% of the rental amount) will be made by the tenant when his/her reservation is made. The dates requested will not be reserved until the 25% deposit is received by Morningstar, LLC. The 75% balance due (less the 25% non-refundable deposit) must be paid 30 days prior to check-in. Payment should be made payable to: Morningstar, LLC
3. SECURITY DEPOSIT: In addition to the rental amount stated above, a $250.00 security deposit will be required from the tenant 30 days prior to the check-in date. The $250.00 security deposit will be refunded to the tenant IF the property, pole barn, cottage and their contents are found to be free from damage and present, after the property, pole barn, cottage, and their contents are cleaned and inspected. If damage is found or items are missing, Morningstar, LLC may use the $250.00 to repair or replace missing or damaged items, property, etc. Thirty days prior to check-in, tenant will provide a valid
credit card number to Morningstar LLC, to be kept on file, in case items are missing or damaged, whose cost to replace or repair exceeds the $250.00 security deposit. Morningstar, LLC may use the credit card on file to cover the cost of repairs or replacing missing or damaged items, property, etc., exceeding $250.00.
4. TOTAL AMOUNT DUE 30 DAYS PRIOR TO CHECK IN: Payment of 75% of the rental amount (balance due), plus the security deposit, is to be made payable to: Morningstar, LLC
5. DIRECTION AND INFORMATION PACKET: Tenant is aware that Morningstar LLC will mail an information packet to him/her after the rental balance, security deposit, and valid credit card number are received, no later than 30 days prior to the check in date stated above. The packet will include directions to the cottage, instructions how to open the lockbox with the key inside, and other useful information.
6. In the event that the tenant is unable to fulfill his/her rental agreement, the tenant will notify any one of the representatives of Morningstar, LLC as soon as possible. This rental agreement is made with the tenant's full knowledge that the property listed above is used for rental purposes and that prompt notification is critical to that end.
7. Michigan Use Tax: The State of Michigan requires us to charge a 6% Use Tax on all rentals. Please note that the tax will only affect the Rental Amount - not the Security Deposit.
CONDITIONS OF RENTAL AGREEMENT
1. OCCUPANTS: Tenant will disclose how many adults, children, and pets will be staying at the cottage during the dates reserved. Tenant also agrees that the number of people, adults and children, spending any night will not exceed 12 people, without written consent from Morningstar, LLC.
2. SMOKING INSIDE THE COTTAGE: There is to be no smoking of any kind, cigarettes, cigars, pipes, etc., inside the cottage at any time. If the tenant and/or his/her guests are seen smoking inside the cottage, or the (smell) of cigarette, cigar, etc., smoke is found inside the cottage during the tenant's stay at the cottage, or when the cleaning crew comes to clean after the tenant has checked out, or cigarette, cigar, etc., butts are found inside the cottage, Morningstar, LLC has the right to retain the full $250.00 security deposit, and charge the entire cost of professionally removing the smell of smoke from the cottage to the tenant's credit card on file.
3. PETS: Pets are not allowed inside the cottage at any time or for any reason. Dogs may be kept in the Timberline Cottage's outdoor kennel, or crated in the pole barn if the tenant brings a crate for his/her dog. All animals must remain on a leash or chain, tied up, or confined at all times, when not inside the kennel. Tenant guarantees that pets will not become a nuisance to the residents in the area with excessive barking, noises, etc. or be permitted to wander the area. Tenant will also make sure that the kennel, pole barn, and yard/property is cleaned and all fecal matter removed from the premise before checking-out on the date stated above.
4. CAMPFIRES: Tenant will maintain control of any campfire and insure that the blaze does not become so large as to threaten the tree canopy above. All campfires will be completely extinguished each night before going inside the cottage for the night, or if the tenant and/or his/her guests are not outside and within plain site of the campfire pit any time day or night.
5. NEED TO BRING LIST: Tenant affirms that he/she has read the "Need To Bring" list provided by Morningstar LLC, and accepts its requirements and intent.
6. TELEPHONE: Tenant is aware that the cottage does not have a telephone and that telephone service is not provided by Morningstar, LLC.
7. POLE BARN: The pole barn is for the use and convenience of our tenants. The tenant will deposit an adequate amount of sorbent, or cat litter, to absorb any spilt oil, solvents, etc., in the pole barn, and will remove the used sorbent or cat litter from the premise once the spill has been adequately absorbed. Tenant will clean and sweep out the pole barn, if used by the tenant or his/her guests, before checking out.
8. DOCK AND LAKE ACTIVITY: Tenant is aware that each dock located on Manistee Lake is private property, owned by each landowner, and is not for public use. Tenant agrees to follow all Michigan laws pertaining to boating and bodies of water located in Michigan, and will adhere to the "No Wake Zone" located between the shore line and the "No Wake Buoy", marked with a black star, and located 100 feet from the end of the closest dock, out in the water. Tenant is aware that because the Timberline Cottage shoreline is approximately 20 feet, and is located in a small cove, there is no dock. All boats and/or watercraft must be securely moored in the water, just off the shoreline. Depending on the time of year, the depth of the water in the Timberline Cottage's area ranges from 1 foot to 4 feet deep. Tenant can launch his/her watercraft into the water at the public park boat ramp, located on the south end of Manistee Lake.
9. NOISE AND DISRUPTIVE ACTIVITIES: Tenant and/or his/her guests shall not disturb, annoy, or endanger the residents in the area with excessive noise, violation of any law, nor commit or permit waste or nuisance in or about the premises at any time, day or night. Tenant guarantees that he/she, his/her guests, and any pets on the premise, will be as quiet as possible, maintaining the public peace between the times of 11:00 p.m. and 7:30 a.m. Tenant also agrees that he/she, his/her guest, and any pets on the premise will not trespass onto any other private property in the area.
10. GARBAGE AND TRASH: Tenant will bag all garbage, trash, etc., from inside the cottage, pole barn, and the property outside, and will take all the bagged garbage, trash, etc. to the garbage shed located at the northeast corner of the property, at the entrance to the road, Timberline NE, before leaving on the check-out date stated above.
11. KEYS AND LOCKBOX: Tenant will return the keys to the lockbox and insure that the keys are securely locked inside the lock box before leaving on the check-out date stated above. If the keys or lockbox are damaged or lost, or keys are not returned to the lockbox after checking out, Morningstar LLC may use the security deposit to cover the cost of replacing the keys and/or lockbox.
12. RIGHT OF ENTRY: Representatives of Morningstar LLC reserve the right to enter, inspect, or repair the property, pole barn, cottage, and their contents for any reason, and at any time, during the duration of the rental dates stated above.
13. SUBLETTING OR ASSIGNING: Tenant agrees not to assign or sublet the premises, or any part thereof, without first obtaining written permission from Morningstar LLC.
14. SUPERVISION OF CHILDREN, GUESTS, FAMILY, ETC.: Tenant assumes full responsibility for the safety, health, and welfare of himself/herself, his/her family, and/or guests. Tenant will insure that children, 17 years old and younger, will be supervised by a responsible adult at all times while they are in/on the lake or in/on any water craft.
15. It is understood and agreed by the tenant that this agreement is to be terminated in the event of destruction or damage of the cottage, pole barn, property, etc., by fire, any other casualty, or "act of God", and any unearned rental is to be prorated and refunded to tenant.
